Terms of Service

These Terms of Service ("Terms") govern your access to and use of Poker Calc at pokercalc.app (the "Service"), operated by FUNKARNU SL (NIF: B75540567), a company registered in Spain. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Service Description

Poker Calc is a web-based Texas Hold'em poker odds calculator and educational tool. The Service provides equity calculations, hand analysis, strategy advice, quiz modes, AI coaching, hand history review, and related poker study features. The Service is intended for educational and informational purposes only.

2. Accounts

  • You may create an account by signing in with Google OAuth. Each person may maintain only one account.
  • You agree to provide accurate information and keep your account credentials secure. You are responsible for all activity that occurs under your account.
  • You must notify us immediately if you become aware of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions and Billing

  • The Service offers a Free tier with daily usage limits on certain features (AI Coach, hand review, image scan, scenario analysis).
  • The Pro tier is available for $5.00 USD per month and provides unlimited access to all features.
  • Payment is processed by Stripe. By subscribing to Pro, you authorize Stripe to charge your payment method on a recurring monthly basis.
  • Subscriptions auto-renew at the end of each billing cycle unless you cancel before the renewal date.
  • You can cancel your subscription at any time through the Account page in the app or via the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period; you will retain Pro access until then.
  • We do not offer refunds for partial billing periods. If you believe you were charged in error, please contact us at hello@pokercalc.app.
  • We reserve the right to change pricing with 30 days' notice. Price changes will not affect your current billing cycle.

4. Free Tier Limitations

The Free tier includes daily usage caps on certain gated features. These limits reset each calendar day (UTC). Specific limits are displayed in the app when you approach or reach them. We may adjust these limits at any time.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Abuse, harass, or threaten other users of the Service.
  • Attempt to gain unauthorized access to the Service, other accounts, or any systems or networks connected to the Service.
  • Use automated scripts, bots, scrapers, or other automated means to access the Service or extract data from it.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
  • Circumvent or attempt to circumvent any usage limits, rate limits, or access controls.
  • Resell, redistribute, or sublicense access to the Service or any content generated by it.
  • Interfere with or disrupt the integrity or performance of the Service.

6. Intellectual Property

The Service, including its design, code, content, graphics, and trademarks, is owned by FUNKARNU SL and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

Content you create within the Service (such as saved hands, ranges, and settings) remains yours. By using the Service, you grant us a limited license to store and process this content solely to provide the Service to you.

7. Disclaimer

The Service is an educational and analytical tool only. It is not gambling advice, financial advice, or a guarantee of outcomes in any poker game or tournament. Poker involves elements of chance, and no calculator or tool can guarantee winning results.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. While we strive for accuracy in our calculations, we do not guarantee the mathematical precision of any result provided by the Service. Monte Carlo simulations are statistical estimates, not exact values.

8. Limitation of Liability

To the maximum extent permitted by applicable law, FUNKARNU SL and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use of or inability to use the Service.
  • Any decisions made or actions taken based on information provided by the Service.
  • Unauthorized access to or alteration of your data.
  • Any third-party conduct on the Service.
  • Any other matter relating to the Service.

In no event shall our total aggregate liability exceed the amount you have paid us in the twelve (12) months preceding the claim, or $50 USD, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless FUNKARNU SL, its operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another.

10. Termination

  • We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include but are not limited to violations of these Terms, abusive behavior, or prolonged inactivity.
  • You may delete your account at any time through the Account page in the app. Upon deletion, your personal data will be permanently removed in accordance with our Privacy Policy.
  • Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.

11. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Spain.

If you are a consumer resident in the European Union, you also enjoy the protection of the mandatory provisions of consumer protection law in your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU consumer protection law.

12. Changes to These Terms

We may modify these Terms at any time. When we make material changes, we will notify you by posting the updated Terms on the Service with a revised "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you should discontinue using the Service.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
